Disclaimer and Legal Notice

Legal information · 24 October 2026

This notice explains the role of Cappadocia Adventure Tours (“we”, “us”), the nature of the tours and activities offered on www.cappadociaadventuretours.com (the “Site”), the information shown on the Site and the limits of our liability. It applies together with our booking terms and privacy notice. By using the Site or booking with us you confirm that you have read this notice. Nothing in it limits the rights that mandatory law gives you as a consumer.

1. Who we are and our role

The Site is operated by Cappadocia Adventure Tours, a tour organiser based in Göreme, Nevşehir, Türkiye.

We organise and sell tours and activities in Cappadocia and arrange them with specialised, licensed operators who actually provide the service on the day: hot air balloon flights are operated by balloon companies licensed and supervised by the Directorate General of Civil Aviation (SHGM); ATV, horse, camel and jeep activities by their licensed operators; transport by licensed vehicle owners and drivers; museum and site visits, shows and workshops by the relevant venues; and guided tours by licensed professional tour guides. Each operator is responsible for its own staff, equipment, vehicles, aircraft, animals, permits and insurance.

Where your booking is a package tour within the meaning of Consumer Protection Law No. 6502 and the Package Tour Contracts Regulation, we are responsible to you for its proper performance as that legislation provides, including where a service is performed by an operator we have chosen. Nothing in this notice reduces that responsibility.

We are a private company. We are not, and do not speak on behalf of, the Ministry of Culture and Tourism, SHGM, the Nevşehir Governorship, any municipality, museum authority or other public body. Official decisions — such as balloon flight permits, opening hours or entrance fees — are made by those authorities alone.

2. Booking requests, prices and availability

A request sent through the Site is not a confirmed booking. A contract is formed only when we confirm your booking in writing as described in our booking terms. No payment is taken on the Site.

We take care to keep prices, timings, itineraries and availability correct, but they can change and errors can occur (for example a typing, currency or technical error). If a price or availability shown on the Site is clearly wrong, we are not bound by it: we will tell you before confirming and you may accept the correct price or cancel without charge. The price and details in our written confirmation prevail.

Durations, distances, pickup times, flight times, stops and routes shown are typical and may vary with traffic, weather, site closures, group size and safety. Museum and site entrance fees are set by the authorities and are not included unless stated.

3. The nature and risks of adventure activities

Hot air ballooning, ATV (quad) riding, horse and camel riding, jeep safaris, valley hikes and similar activities are outdoor adventure activities. Even when carried out correctly and with all required care, they involve inherent risks that cannot be fully removed, including uneven or hard balloon landings, falls, collisions, rough or slippery terrain, unpredictable animal behaviour, heat, cold, sun, dust, insects and the effects of early starts and altitude.

Balloon landings depend on wind and may be firm; passengers must adopt the landing position shown by the pilot. Horses and camels are living animals and may react unexpectedly. ATVs are motor vehicles: speed, distance between vehicles and the guide’s route must be followed.

By booking an activity you confirm that you understand these inherent risks and choose to take part voluntarily. This acceptance relates only to risks that are inherent in the activity itself; it does not cover harm caused by the fault of us or of an operator, for which liability remains as set out by law.

4. Your health and suitability declaration

When you book, you confirm for yourself and every person in your booking that each participant is in suitable health and physical condition for the chosen activity, and that you have given us correct information about age, weight, medical conditions, mobility and any special needs.

In particular, balloon flights are not suitable during pregnancy, for children under the minimum age shown on the tour page, or for people with serious heart, lung, back, neck, joint or balance conditions, recent surgery or injury, or limited mobility that prevents climbing into or crouching in the basket. Guests over 120 kg must tell us in advance. ATV drivers must be at least 18 and hold a valid driving licence; younger guests may ride only as passengers where permitted. Age, height and weight limits shown on each tour page apply.

If you are unsure, please ask your doctor before booking. The pilot, guide or operator may refuse participation for safety reasons — for example if a participant appears unwell, is under the influence of alcohol or drugs, does not meet the limits, or does not follow instructions. Where this results from incorrect or missing information given by you, or from your own conduct, the refund rules in our booking terms for late cancellation or no-show apply.

Parents or guardians are responsible for the supervision of children in their care throughout the tour.

5. Safety rules and your conduct

Participants must follow the safety briefing and instructions of the pilot, guide, driver and operator at all times, use the safety equipment provided (such as helmets) and wear suitable clothing and closed footwear.

Alcohol and drugs are not permitted before or during activities. Participants may not leave the group, the route or the vehicle without the guide’s permission, enter closed or prohibited areas, climb fairy chimneys or rock formations, or behave in a way that endangers themselves, other people, animals or the cultural and natural heritage of the area.

To the extent permitted by law, we are not liable for loss, injury or damage caused by a participant ignoring instructions, giving incorrect information about their health or abilities, acting under the influence of alcohol or drugs, or acting recklessly. You are responsible for damage you cause intentionally or negligently to vehicles, equipment, animals, property or third parties.

6. Weather, balloon flight permits and changes

Balloon flights take place only when SHGM permits them each morning, based on wind and weather. This decision is made by the authority and the pilot, not by us, and it can be taken at the last minute, even after pickup. If a flight is cancelled, you are offered the next available morning or a refund of the amount paid, as set out in our booking terms.

Weather, road conditions, site closures, official decisions or safety may also require us to change, shorten, delay or cancel another tour or activity. In such cases we offer an alternative or a refund of the part that could not take place, as set out in our booking terms.

To the extent permitted by law, we are not responsible for indirect costs caused by such a cancellation or change, such as hotel nights, onward flights, transfers or other plans you have made. We recommend planning at least one spare morning for a balloon flight.

7. Insurance

Balloon operators hold the compulsory passenger liability insurance required by law, and other operators hold the insurance their activity requires. This insurance covers the operator’s legal liability and is not personal travel insurance.

We strongly recommend that every guest has personal travel insurance that covers medical treatment, emergency transport, cancellation, personal belongings and the adventure activities you plan to do (some policies exclude ballooning or quad riding — please check yours).

8. Personal belongings

You are responsible for your own belongings, including cameras, phones, drones, jewellery, documents and money, during pickup, transport and activities. Please keep them secure; loose items may be lost or damaged in a balloon basket, on an ATV or on horseback.

To the extent permitted by law, we are not liable for the loss, theft or damage of belongings unless caused by our fault or by the fault of an operator, in which case the legal rules on liability apply. Drones may be flown only where the law and the operator allow it.

9. Photos, videos, maps and descriptions

Photos, videos, 3D maps, route animations and descriptions on the Site show the kind of experience offered and are for information only. Actual views, the number of balloons in the sky, landscapes, vehicles, baskets, animals, venues and routes may differ depending on season, weather, the operator assigned on the day and conditions on the route.

Route lines and stop markers on maps are approximate and are not navigation data. Please do not use them to travel on your own in the valleys.

10. Live data and forecasts on the Site

The balloon flight status panel, sector flags, wind outlook, sunrise and sunset tables and similar indicators are provided as a convenience. Sector flags are taken from SHGM’s published information and may be delayed or out of date; the wind outlook is a weather forecast. These indicators are not a flight decision, a booking confirmation or a guarantee; only the authority and the pilot decide whether balloons fly.

Sunrise and sunset times are calculated and approximate. Live data comes from third-party sources and may be unavailable, late or incorrect. To the extent permitted by law, we are not liable for decisions you make relying only on these indicators.

11. Third-party operators, websites and services

Hotels, restaurants, shops, flights, airport transfers and other services that you book yourself, as well as websites and services linked from the Site (such as maps, messaging and payment apps), are provided by third parties under their own terms. We are not a party to those contracts and are not responsible for their content, availability, quality or privacy practices.

Shops, workshops and restaurants visited during a tour are independent businesses. Any purchase you make from them is a contract between you and that business; we do not guarantee their goods, prices or after-sales service.

12. Reviews and content about people and businesses

Information on the Site about places, venues, businesses and people is prepared in good faith from our own experience and public sources, for information only. Comparisons and recommendations are opinions, not statements of fact, and are not intended to discredit or harm anyone. Trademarks and names belong to their owners and are used only for identification.

Reviews, comments, photos and messages sent by guests express the views of their authors, who are responsible for them. We may refuse or remove content that is unlawful, misleading, offensive or that infringes the rights of others.

Notice and takedown: if you believe that any content on the Site is incorrect or infringes your personal rights, trademark, copyright or other rights, please write to info@cappadociaadventuretours.com with the page address and your reasons. We review notices promptly under Law No. 5651 and related legislation and correct or remove content that we find justified.

13. Availability and security of the Site

We aim to keep the Site available and secure but do not guarantee that it will work without interruption or error. We may change, suspend or withdraw any part of the Site. To the extent permitted by law, we are not liable for loss caused by unavailability of the Site, technical faults, cyber attacks or harmful code beyond our reasonable control. Your booking rights are not affected: if you cannot reach the Site, contact us by email or phone.

14. Limitation of liability

To the maximum extent permitted by applicable law, Cappadocia Adventure Tours, its managers, employees and agents are not liable for indirect or consequential loss, such as loss of profit, loss of enjoyment beyond the value of the service, missed connections or costs of other travel arrangements, arising from the use of the Site or from a tour or activity. Where liability for a booked service cannot be excluded but may lawfully be limited, it is limited to the price paid for that service, unless the law provides otherwise.

These limitations do not apply to liability for intent or gross negligence (Turkish Code of Obligations Article 115), to liability that the law does not allow to be excluded or limited — including death or personal injury caused by fault and the liability of licensed professional services under Article 115(3) — or to your rights under Consumer Protection Law No. 6502, the Package Tour Contracts Regulation and other mandatory rules of the law that applies to you.

15. Your obligations when using the Site

You agree to use the Site lawfully, to give true and complete information in booking requests and not to copy, scrape or misuse its content. You are responsible for claims, losses and costs that we suffer as a result of false information you provide, content you submit or your unlawful use of the Site, to the extent of your fault and as the law allows.

16. Force majeure

We and our operators are not liable for failure or delay in performing a service caused by events beyond reasonable control, such as extreme weather, natural disasters, epidemics, war, terrorism, unrest, strikes, road closures, official decisions, flight bans or failures of power and communication networks. In such cases we offer an alternative or a refund of the services that could not be provided, as required by our booking terms and the law.

17. Severability, changes and governing law

If any part of this notice is found invalid, the remaining parts stay in force and the invalid part is replaced by the closest lawful provision. We may update this notice at any time; the version published on this page applies to bookings confirmed after its date. This notice is read together with our booking terms and privacy notice; for a confirmed booking, the booking terms and your written confirmation prevail.

This notice is governed by the laws of the Republic of Türkiye. Consumers may apply to consumer arbitration committees and consumer courts, and keep any rights given by the mandatory law of their country of residence.
